TERMS OF PURCHASE

As well as the Terms of Website Use, these terms and conditions (“the Terms of Purchase“) set out the additional conditions under which you may purchase products, services or gift vouchers appearing on this website. By making application, you are agreeing that an agreement exists between you and Asset Management Engineers immediately. Each application is a separate agreement.

Accounts
You must take responsibility for the safekeeping of any username and password, as you are liable if any unauthorised person should access your data by using your username and password.

Security

Orders
If you place an order or select to purchase products from the website, including from affiliate suppliers via hyperlinks from this website, Asset Management Engineers reserves the right to accept or reject an order for any reason including without limitation, unavailability of product; an error in the price, image or the product description; or error in your order. Orders are deemed to have been received at the time of successful transmission of the order, and you will thereafter be unable to cancel the order. Returns and refunds are undertaken in certain circumstances only, as outlined below.

Payment
You must pay for your products or services purchased on this website at the time of placing an order. To pay for products and courses you will use the SecurePay secure payment facility. You agree that SecurePay is responsible for processing and the security of your payment, and you hereby release Asset Management Engineers from any liability in relation to such payment. Please refer to SecurePay terms of use for conditions applying to their payment processing services.

To further ensure the integrity of your payment information (Credit / Debit Card, EFT, Paypal, etc.), Asset Management Engineers uses the services of a third party Gateway provider. We never receive, record, or store your personal financial details, or pass them on to another party.

Variation of Products and Price
All prices listed are in Australian Dollars (AUD).  Prices listed on this website may vary at any time and are subject to change until you have paid for the products or services in full.

RETURNS / REFUNDS POLICY

Summary
Asset Management Engineers always intends to treat all customers fairly and with integrity at all times. This includes procedures related to refunds, replacement items, or product returns.

Product refunds or Returns will be treated strictly within the legal requirements of Consumer law. Asset Management Engineers has no responsibility for products or services provided by any other parties linked to the website.

We do not give any money back or credit refunds if:
• the purchaser changes their mind;
• if you are unable to attend your chosen training course (at our discretion, an alternative date may be offered if available);

Cancellations
We may cancel a Contract if the purchased Product is not available for any reason. We will notify you if this is the case and return any payment that you have made. We will usually refund any money received from you using the same method originally used by you to pay for the Product, however other arrangements may be made if mutually agreeable.

Faulty Products
We warrant that:
• the Product will be delivered undamaged in the quantities ordered; and
• the Product will conform with the manufacturer’s latest published instructions as set out on the Site or in our Product material at the time of your Order.

The Product is intended to be used strictly in accordance with the manufacturer’s latest published instructions as set out on the Site or as on the Product itself. It is your responsibility to ensure that you use the Product strictly in accordance with those instructions.

We try very hard to deliver Products in excellent condition. However, if you tell us that the Product is faulty, you agree to keep the Product in its current condition available for us (or our agent) to inspect within a reasonable time.

In order to provide you with any remedies for a faulty Product, we may need your assistance and prompt provision of certain information regarding the Product, including:
• you specifying with reasonable detail the way in which it is alleged that the Product is damaged or defective; and
• you providing us with the delivery note number and such other information as we reasonably require.

If you would like us to repair, replace or provide a refund for the Product where it did conform to the applicable Contract, and we find that the Product has:
• been misused, abused or subjected to neglect, improper or inadequate care, carelessness, damage or abnormal conditions; or
• been involved in any accident or damage caused by an incorrect attempt at modification or repair; or
• been dealt with or used contrary to our or the manufacturer’s instructions for the Product; or
• deteriorated through normal wear and tear, after delivery by us, we may at our discretion decide not to repair, replace or refund you for the Product and/or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or the payment details that you provided to us when you made your Order, and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.

Refund Process

Any refund due will be paid only to the person or party that made the original payment.

Asset Management Engineers does not see your financial details, and cannot refund a Credit or Debit Card directly. This must be done through the payment gateway or financial institution by reversing the original transaction, or by crediting your card. Using the original transaction reference number ensures that the refund goes directly to the original card. This process may sometimes involve the disclosure of further information.

Any reversal of a transaction can only be to the amount of the original transaction – if two products are paid on separate transactions, then refunds must be handled individually, and cannot be rolled together.

Similarly, a transaction can only be reversed ONCE. If multiple payments are made on a single card transaction and a partial refund is agreed, no further refund is available against that transaction reference number. If further refunds are identified, they must be treated individually through separate processes.

Refund may take up to 10 days to complete. Attempts will be made to streamline the process, but there are also delays incurred with transfers between bank accounts.

Under no circumstances will cash refunds be made, regardless of the original method of payment.

If the original card has expired, been lost, or cancelled by the owner it cannot be used for a refund. Attempts to reverse a transaction will fail. An alternate refund method will be needed.

SHIPPING POLICY

Asset Management Engineers ship to residential and commercial addresses, as well as PO Boxes, across Australia. We charge a flat rate of $20 per order.  If you prefer, you can pick up your order from our office in Belmont or Kalgoorlie – please select ‘local pick up’ at checkout.

We use Australia Post regular mail for all orders, which are tracked using the barcode provided at time of shipping – which can be provided upon request.

DISCLAIMER

We aim to deliver the Product to you at the place of delivery requested by you in your Order.

We shall aim to let you know if we expect that we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

Please note that it might not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you make your Order and arrange for cancellation of the Order or delivery to an alternative delivery address.

Unless otherwise specified, all risk in the Product shall pass to you upon delivery, except that, where delivery is delayed due to a breach of your obligations under a Contract, risk shall pass at the date when delivery would have occurred but for your breach. From the time when risk passes to you, we will not be liable for loss or destruction of the Product.

You must take care when opening the Product so as not to damage it, particularly when using any sharp instruments.
You shall ensure that you are ready for safe receipt of the Product without undue delay and at any time reasonably specified by us.
If you are not available to take delivery or collection, Australia Post may leave a card giving you instructions on either re- delivery or collection from the carrier.

If delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within two weeks of our first attempt to deliver the Product to you) accept delivery or collect the Product from the carrier, then we may (without affecting any other right or remedy available to us) do either or both of the following:

• charge you for our reasonable storage fee and other costs reasonably incurred by us; or
• no longer make the Product available for delivery or collection and notify you that we are immediately cancelling the applicable Contract, in which case we will refund to you or your credit or debit card company as applicable any money already paid to us under the applicable Contract, less our reasonable administration charges (including for attempting to deliver and then returning the Product, and any storage fees as provided for in clause 5.11(a) above).

It is your responsibility to ensure that the Products are sufficient and suitable for your purposes and meet your individual requirements. We do not warrant that the Products will meet your individual requirements. You acknowledge that the Products are standard and not made bespoke to fit any particular requirements that you may have.

TRAINING CANCELLATION POLICY

Cancellation and Reschedule Policy for Training Courses

Substitutions of attendee may be made up to 24 hours before the training course commences.

Cancellation and/or reschedule requests must be received in writing by email or fax. You are responsible for ensuring that Asset Management Engineers receives your written request. Asset Management Engineers will reply with a written acknowledgement.

If you cancel more than 15 days prior to the first date of training, your training fee will be fully refunded.

Cancellation requests received 10 to 15 days prior to the course date will result in a credit toward attendance at a future scheduled training, taking place within 12 months of the original training. Rescheduling is allowed on a one-time basis only, with no further rescheduling permitted. If you do not attend a training course within 12 months from the original course, the entire training fee will be forfeited.

Cancellations made 5 to 10 days prior to the course date will result in a 50% refund of the cost of the training course.

Cancellations made between 5 and 2 days prior to the course date will result in a 25% refund of the cost of the training course.

Cancellations made less than 2 days prior to the course date, or failure to appear for the training course, will result in forfeiture of the course fee.

Asset Management Engineers reserves the right to cancel training at any time. If Asset Management Engineers cancels the training due to unforeseen circumstances beyond the control of Asset Management Engineers, you are entitled to a full refund of the course fee, or your course fee can be credited toward a future training, which would be scheduled at your convenience based upon availability. Asset Management Engineers reserves the right to reschedule training at any time. If Asset Management Engineers reschedules training due to unforeseen circumstances beyond the control of Asset Management Engineers, the training will continue at the next available time that is convenient for you. Asset Management Engineers is not responsible for travel arrangements, travel fees, or any expenses incurred by you as a result of such cancellation or reschedule.
